The direct lease between Dropbox and Landlord (the “ Dropbox Lease”) is scheduled to expire on February 28, 2023. The Suite 3400 Sublease is scheduled to expire on January 31, 2023. (“ Dropbox”), as sublandlord, and Tenant, as subtenant. Tenant currently occupies the Suite 3400 Premises pursuant to a sublease (the “ Suite 3400 Sublease”) dated February 23, 2016, between Dropbox, Inc. Except as provided in this Fifth Amendment, effective as of the Suite 38 Commencement Date, the term ' Premises' as used in the Lease shall mean, collectively, the Existing Premises and the Suite 38 Premises.Ģ.4. Effective upon the Suite 38 Commencement Date, the Premises shall be increased to include the Suite 38 Premises. Except as specifically set forth in the Work Letter attached hereto as Exhibit B (the ' Fifth Amendment Premises Work Letter'), Landlord shall not be obligated to provide or pay for any improvement work or services related to the improvement of the Suite 38 Premises, and Tenant shall accept the Suite 38 Premises in its presently existing, 'as-is' condition. As used herein, the ' Suite 38 Delivery Date' shall mean the date on which Landlord delivers the Suite 38 Premises to Tenant in the condition required hereunder, which Suite 38 Delivery Date is anticipated to occur on December 1, 2019. The ' Suite 38 Commencement Date' is the date that is six (6) months following the Suite 38 Delivery Date.
